Charlotte Agents: Canopy MLS Won't Accept a Caption — It Has to Be on the Photo

Canopy MLS Rule 1.18.1 requires the disclosure directly on the image. A disclosure provided only in captions, agent remarks, or supplemental text is not acceptable.

Informational only — not legal advice, not a substitute for counsel, and no attorney-client relationship is created. Confirm every rule with your broker and a licensed real-estate attorney before relying on it. This entry is verified against the board or statute’s own public rulebook.

Avoid NC fines — stage compliantly

Broker warning

If your staging tool only adds a caption, you're not meeting Canopy requirements. The disclosure has to be ON the image — a watermark, not just text in the description. Double-check your workflow.

What you need to disclose

Rule 1.18.1: for AI-enhanced and virtually staged photos, renderings and virtual tours, the disclosure must be clear, readily visible, and directly ON the image or within the virtual tour. Disclosure provided only in captions, agent remarks, or supplemental text is not acceptable.

What happens if you don't

Enforced under Canopy's compliance program (Sections 8.4 and 8.5). Virtual-staging problems are not separately listed; the Category I catch-all applies to rule violations not listed in Categories II-IV. The first Category I violation carries no fine and must be corrected within two business days (Section 8.4.1).

What's allowed

Replace personal property items, cosmetic alterations with no structural changes. AI-enhanced and virtually staged images ARE permitted for proposed/under-construction properties.

What's banned

Adding or generating visual elements not within the owner's control or not physically possible (for example views, added amenities or structural features, changed room dimensions); removing or concealing such elements or hiding material defects (Rule 1.18.1(a)-(b)).

Questions North Carolina agents ask about virtual staging

What makes Canopy MLS disclosure rules different?

Canopy MLS Rule 1.18.1 requires a clear, readily visible disclosure directly on the image or within the virtual tour. A disclosure provided only in captions, agent remarks, or supplemental text is not acceptable.

Can I virtually stage pre-construction properties in North Carolina?

Yes. Canopy MLS Rule 1.18.1(d) permits AI-enhanced and virtually staged images on proposed or under-construction listings when they are labeled as required, which is more permissive than Stellar MLS in Florida, where Article 04.04 bars virtual staging on pre-construction and under-construction properties.

How does RELTO handle Canopy MLS requirements?

RELTO applies on-image watermarks per Canopy MLS requirements and pairs original photos alongside staged versions in the correct sequence.
