# Tennessee Agents: Rule 1260-02-.12 Covers Every Channel; Each MLS Sets Its Own Staging Rule

Tennessee's advertising rule specifically names social media, websites, email signatures, and streaming — and requires the firm name to be at least as large as the licensee's. Realtracs, MAAR, and East Tennessee REALTORS each add their own virtual-staging rules.

## Summary

Tennessee has no virtual-staging-specific statute, but Tenn. Comp. R. & Regs. 1260-02-.12 is a detailed advertising rule explicitly covering traditional media, websites, social media, and video/audio streams. The firm name must appear in letters the same size or larger than the licensee name; websites must show the firm name/phone on every page; social-media ads must keep the firm name/phone "no more than one click away" from the viewable page. The rule also provides that no licensee shall advertise in a false, misleading, or deceptive manner. The Tennessee Consumer Protection Act (Tenn. Code Ann. §47-18-104) also applies; its remedies section could not be read for this page. Among the MLSs: Realtracs (Nashville and central Tennessee), MAAR (Memphis), and East Tennessee REALTORS (Knoxville, formerly KAAR); each has its own staging rule. Realtracs and MAAR also restrict text or other overlays on listing photos (see MLS systems below), so an on-image disclosure stamp may conflict with their rules.

## Virtual staging laws in Tennessee

### Tenn. Comp. R. & Regs. 1260-02-.12 — Advertising

Applies to every form of advertising a licensee uses — traditional print, radio, television, signs, flyers, letterheads, email signatures, websites, social media, and internet/broadcast streaming. All advertising must be under the direct supervision of the principal broker and must list the firm name and firm telephone number as filed with TREC. The firm name must appear in letters the same size or larger than those spelling out the name of a licensee. Websites must disclose the firm name and phone on every page; social-media ads must keep that information "no more than one click away" from the viewable page.

### Tennessee Consumer Protection Act (Tenn. Code Ann. §47-18-104)

Prohibits unfair or deceptive acts or practices affecting the conduct of trade or commerce. The Act's remedies provisions could not be read from a primary source for this page, so confirm them before relying on a private-action or damages claim.

## What Tennessee MLS boards require for virtual staging

### RealTracs

- Disclosure rule: Rule 2.19(e) (last revised July 28, 2026): all virtually staged images must be designated as such in the media remarks, and an image of the existing room or property in its current state must be included immediately before or after the virtually staged image, except on To-Be-Built and Under Construction listings.
- Permitted: Furniture, mirrors, artwork, rugs, and plants, and landscaping improvements that could realistically be made.
- Prohibited: Furniture or personal property that will not fit, views that do not exist, fixed features that do not exist, removing power lines, utility poles, or water towers, and overlays of text, photos, or logos on images (Rule 2.19(d)).
- Penalty: Fines under the Rule 1.13 Infractions and Penalties Schedule; Realtracs staff may remove photographs (Rule 2.19(g)).

### Memphis Area AR (MAAR)

- Disclosure rule: MAAR MLS Rules, Note 5 (Section 1.2): disclosure of virtually staged photos is required in REALTOR® Remarks. (Text confirmed in the February 7, 2024 edition; the February 2026 edition could not be opened.)
- Permitted: Virtual staging of the interior of an existing structure.
- Prohibited: Virtually staging the exterior of the property; removing, altering, or adding permanent fixtures or structural elements such as walls, ceilings, or floors; adding elements outside the owner's control, such as views; excluding negative visual elements such as holes or exposed wiring; people or words on a photograph (as written in the 2024 edition).
- Penalty: Not confirmed; check the MAAR fine schedule.

### East Tennessee REALTORS (formerly Knoxville Area AR, KAAR)

- Disclosure rule: The 2026 MLS Rules require the listing to clearly disclose that media has been digitally altered, for example as "Virtually Staged," in MLS public remarks or another MLS-approved method, and the original photo before any enhancements must be uploaded before the digitally altered version.
- Permitted: Virtual staging where no walls, rooms, or structural elements are added, moved, or removed.
- Prohibited: Adding, moving, or removing walls, rooms, or structural elements; removing power lines or neighboring buildings, eliminating defects, creating or enhancing views, and any person or figure, including AI-generated persons.
- Penalty: Not confirmed; check the East Tennessee REALTORS fine schedule.

## What happens if you skip disclosure in Tennessee

- License Discipline (regulatory): TREC can discipline licenses for misleading or deceptive advertising
- Consumer Protection Act (civil): Tennessee Consumer Protection Act; remedies could not be read from a primary source for this page
- MLS Enforcement (mls): Realtracs, MAAR, and East Tennessee REALTORS enforcement per their listing rules

## What you need to know

- RealTracs covers Nashville and most of central Tennessee
- Memphis and Knoxville each have their own REALTOR association MLSs
- Realtracs Rule 2.19(d) prohibits digitally altering images to include overlays of other images, text, photos, or logos; MAAR (2024 edition) prohibits people or words on a photograph. An on-image text stamp may conflict with these rules, so use the media-remarks disclosure there
- Realtracs Rule 2.19(e) requires a before image next to each virtually staged image and designation in the media remarks
- TREC Rule 1260-02-.12(3)(f): no licensee shall advertise in a false, misleading, or deceptive manner

## How to disclose properly

- Realtracs: designate staged images in the media remarks and place an image of the existing room immediately before or after
- MAAR: disclose virtually staged photos in REALTOR® Remarks (the 2024 edition also prohibits words or people on a photograph)
- East Tennessee REALTORS: clearly disclose digitally altered media and upload the original before the altered version
- Best practice: apply disclosure to every marketing channel

## Broker warning

Tennessee's Consumer Protection Act allows civil claims for deceptive practices, and an undisclosed staged photo that misleads a buyer can create civil exposure. Each Tennessee MLS has its own staging rule, so check the board your listing is on.

## Questions Tennessee agents ask about virtual staging

### Does Tennessee have a virtual-staging-specific law?

### Which MLSs serve Tennessee?

RealTracs is the primary MLS serving Nashville and most of central Tennessee. Memphis is covered by the Memphis Area AR (MAAR) MLS. Knoxville is covered by East Tennessee REALTORS (formerly Knoxville Area AR, KAAR). Each has its own virtual-staging rule.
