# Ohio Agents: Brokerage Name Rules Plus Different Staging Rules in Each MLS

Ohio Admin. Code 1301:5-1-02 doesn't name virtual staging. The staging rules sit in the MLS rulebooks: Cincy MLS requires the words VIRTUALLY STAGED on the image, and MLS Now requires disclosure in the photo description field.

## Summary

Ohio has no virtual-staging-specific statute, but Ohio Admin. Code 1301:5-1-02 requires advertising within the licensee's ownership or direct control to identify the licensee by name and display the brokerage name at least in equal prominence with the salesperson's, and requires licensee-controlled websites to show the brokerage name on every viewable page. Rule 1301:5-1-21 requires team advertising to show the brokerage name in equal or greater prominence than the team name and the salesperson's name. R.C. 4735.18(A)(21) allows discipline for advertising that is misleading or inaccurate in any material particular. Whether a listing photo falls under the Ohio Consumer Sales Practices Act is not addressed by the statute. Primary MLSs are MLS Now (Cleveland/Akron), the Columbus and Central Ohio Regional MLS, and the Multiple Listing Service of Greater Cincinnati (Cincy MLS), and their staging rules differ.

## Virtual staging laws in Ohio

### Ohio Admin. Code 1301:5-1-02 — Advertising

Requires every real-estate advertisement to identify the licensee by name and to display the brokerage name at least in equal prominence with the salesperson's name in advertising within the licensee's ownership or direct control. Websites must disclose the brokerage on every viewable web page; electronic messages with limited characters must provide a direct link to a compliant display. Advertising listings not held with the licensee's brokerage requires written owner consent and disclosure of the listing brokerage's name.

### Ohio Admin. Code 1301:5-1-21 — Team advertising

Requires team advertising to include the brokerage name in equal or greater prominence than the team name and the name of the salesperson.

### Ohio Rev. Code 4735.18(A)(21) — Misleading advertising

A ground for discipline by the Division of Real Estate: advertising that is misleading or inaccurate in any material particular.

### Ohio Consumer Sales Practices Act (R.C. 1345.02)

Prohibits unfair or deceptive acts or practices by a supplier in connection with a consumer transaction. The Attorney General can bring enforcement actions under R.C. 1345.07. Under R.C. 1345.09 a consumer may rescind or recover actual economic damages plus up to $5,000 in noneconomic damages; attorney fees may be awarded under 1345.09(F) in limited circumstances.

## What Ohio MLS boards require for virtual staging

### MLS Now (Cleveland/Akron)

- Disclosure rule: Rule 3.7 (document dated 7/7/2023): disclosure of virtually staged photos or renderings is required in the specified field, namely the photo description entry field.
- Permitted: Interior of an existing structure only: adding furniture, mirrors, artwork, or plants, or removing existing furniture and replacing it.
- Prohibited: Staging an exterior; removing, altering, or adding permanent fixtures; excluding negative visual elements; people or words on the photograph; staging To-Be-Built or Under Construction properties.
- Penalty: Removal of the photos, and fines assessed for repeat offenders (Rule 3.7).

### Columbus REALTORS MLS

- Disclosure rule: The Columbus and Central Ohio Regional MLS Rules and Regulations (February 2026) contain no virtual-staging or photo-alteration rule. The MLS also publishes a separate Policy Violation Manual that was not reviewed for this page; confirm with the MLS. NAR Code of Ethics Article 12 still applies.
- Permitted: Not addressed in the published rulebook.
- Prohibited: Not addressed in the published rulebook.
- Penalty: Not applicable; no staging rule in the published rulebook.

### Cincy MLS

- Disclosure rule: Rule 11.3 (rules revised 2/11/2026): virtual staging may be used for the interior of a structure only, and the image must state the phrase "VIRTUALLY STAGED" in a clear and reasonably sized font on the image. Photos may not include other verbiage.
- Permitted: Interior virtual staging with furniture, mirrors, artwork, or plants. Rule 11.4 limits AI and other media modification to enhancements such as lighting adjustments, image sharpening, and sky replacements.
- Prohibited: Altering the real property or surrounding property, including permanent fixtures, wall colors, carpet, countertops, or views; hiding physical defects or negative visual elements (Rule 11.3). Rule 11.4(b) also prohibits adding, modifying or removing structural elements, interior layout, landscaping or bodies of water, and concealing neighboring structures, power lines or roadways.
- Penalty: Not confirmed; check the Cincy MLS fine schedule.

## What happens if you skip disclosure in Ohio

- License Discipline (regulatory): The Ohio Division of Real Estate can discipline licenses; R.C. 4735.18(A)(21) allows discipline for advertising that is misleading or inaccurate in any material particular, and failing to advertise as Rule 1301:5-1-21 provides is prima facie evidence of a violation of it
- Consumer Sales Practices Act (civil): R.C. 1345.07 allows Attorney General enforcement; R.C. 1345.09 gives a consumer a private action for rescission or actual economic damages plus up to $5,000 noneconomic damages
- MLS Enforcement (mls): MLS Now, Columbus REALTORS, and Cincy MLS enforcement per their listing rules

## What you need to know

- Ohio Admin. Code 1301:5-1-02 requires the brokerage name at least in equal prominence with the salesperson's in advertising the licensee controls, and on every viewable page of licensee-controlled websites
- Rule 1301:5-1-21 requires the brokerage name in equal or greater prominence than the team name
- Cincy MLS requires the words VIRTUALLY STAGED on the image; MLS Now requires disclosure in the photo description field; the Columbus rulebook has no staging rule
- Ohio CSPA: a consumer may rescind or recover actual economic damages plus up to $5,000 noneconomic damages (R.C. 1345.09)

## How to disclose properly

- Cincy MLS: the phrase "VIRTUALLY STAGED" on the image itself (Rule 11.3)
- MLS Now: disclose virtual staging in the photo description entry field (Rule 3.7)
- Brokerage name at least in equal prominence with the salesperson's in advertising you control; on every viewable page of your website
- For character-limited electronic messages, provide a direct link to a compliant display
- Best practice: keep original unaltered images available for review

## Broker warning

Ohio requires the brokerage name in advertising you own or control, including websites and social networking sites. Layer the MLS staging rule for each board on top of that: Cincy MLS wants the words VIRTUALLY STAGED on the image, and MLS Now wants disclosure in the photo description field.

## Questions Ohio agents ask about virtual staging

### Does Ohio have a virtual-staging-specific law?

No. Ohio Admin. Code 1301:5-1-02 governs real-estate advertising within the licensee's ownership or direct control and requires brokerage identification. Undisclosed digital alterations could also be argued to fall under NAR Article 12 and the Ohio Consumer Sales Practices Act; the staging-specific rules are in each MLS rulebook.

### Which MLSs serve Ohio?

Cleveland and Akron are served by MLS Now. Columbus is served by the Columbus and Central Ohio Regional MLS. Cincinnati is served by Cincy MLS (the Multiple Listing Service of Greater Cincinnati). Cincy MLS and MLS Now have their own staging rules; the Columbus rulebook has none.
